Do admitted terrorists get credit for time served?

Recently admitted al Qaeda agent Ali Saleh Kahlah al-Marri lived in a naval brig in South Carolina for nearly six years before pleading guilty when he was finally given the chance to have a trial.  

Given the charges he is admitting to, he is looking at a maximum of 15 years in prison, plus monetary penalties.  

Given that we are a nation of laws, and not men, should this clown get credit, six years to be exact?

The judge apparently can consider the his time served but is not obliged to take it into account.  Is it ok to get no credit for being incarcerated just because they gave you a label that defied explanation?  Was your actual incarceration just as illusory as your legal status?

How far we have fallen.
